My client moved into supported/exempt accommodation in April 2023 . . Having lived previously in a nursing home,
Council Tax discount was implemented immediately but SWD did not make a claim for HB at the time, We completed a claim in July and received 1 month backdate. I applied for DHP for the months prior to HB being awarded and this was refused but I am not sure if LA still has a responsibility to invite a claim when they know tenant is in place ?

You’d think so but don’t think you can argue they should have invited HB claim.

Think you’d be looking at complaint against the social work team, maybe see our factsheet How to resolve problems and complain about social care

I’d be arguing for compensation to cover his HB loss to cover the rent.
