Hi
I have a client who receives legacy benefits and her son is starting a full time Level 4 course so her CTC & CB is stopping.  The course is free so no student income BUT can he apply for anything?  He is also in good health so no LCW/LCWRA option.  He is also her carer (no CA due to full time studies) so if he were to claim UC how would he be treated as a carer or a full time student?  Would he be expected to leave his course if there was a job? How does UC deal with such claims if anything would be payable?

Thanks!

Jojo,

He will not be entitled to UC as he is a full-time student. The Carer Element of UC has the same qualifying conditions as Carer’s Allowance (see p. 72 of current CPAG Welfare Benefits and Tax Credits Handbook.

You mention that the course is free, but just wondered if he would be eligible for any Student Finance ( See below)
The Carers Trust will have further info
