Does anyone have any case law regarding coercive control and a failure to notify a relevant change of circs giving rise to an overpayment

I dont think the cl in this particular case could be considered as the ‘partner’ of the abuser but in case this is what the DWP decide then we may need a second argument to run alongside the cohabitation decision appeal.

Cl is significantly disabled and a ‘friend’ moved in to care for them when they came out of hospital after surgery. The ‘friend’ appears to have been extremely controlling and coercive and by veiled threats and misinformation ‘persuaded’ my cl not to report a change of circs. 

The friend did not stay for more than a few weeks and the cl has neither seen or heard from them for more than a year. My cl.has no contact details for the ‘friend’ and cannot contact the ‘friend’ even if they wanted to (which is very unlikely as the cl. is traumatised by the whole experience).

if said friend only moved in temporarily there’s no overpayment, surely.
