Oxygen - reasonable adjustments
My client failed WCA in Oct 21. Suffers from severe cluster headaches daily that are treated with oxygen and injection.
DWP say that a prospective employer would have a responsibility under the EA 2010 to make adjustments such as providing portable oxygen and safe storage etc of same along with quiet space for the client to administer the oxygen.
Consequently they say that although this may rule out some places of employment it does not rule out all and therefore he does not have LCW.
Any thoughts as to how I might respond? Hearing on 24/4
Would be useful to know what you think he’s entitled to - LCW/WRA, does he satisfy any of the descriptors, or are you aiming for the risk to health etc provision?
