client is separated and living with their child in home owned solely by his partner (she moved out).  I’m not in work so can’t access resource material so can anyone please confirm if he’s is entitled to housing costs even though his name isn’t on the mortgage?

Yes, if she’s liable but not paying, and he can show it’s reasonable for him to meet the costs in order to stay in the home. CIS/688/2010 concerns how to decide when a loan was incurred, in a case where “the claimant fell under paragraph 2(1)(b) of Schedule 3 of the Income Support (General) Regulations 1987, as a person meeting the housing costs, because her ex-husband was not meeting them and it was reasonable to meet those costs in order to continue to live in the house.”
