ESA appeal to the upper chamber when a new claim has been made

Hi

In May 2011 a client of mine lost her ESA appeal. The client made a new claim for ESA and is currently being paid it at the assessment rate.

However, after I lost the appeal I also asked for the statement of reasons. I only received the statement of reasons today because the tribunal judge has been on sick leave. In my opinion, there are a number of errors of law in the statement of reasons. If I appeal to the upper chamber could it cause any problems with the current claim?

How did you manage to get the Statement of Reasons so quickly?    We are still waiting for an SoR for an appeal that was heard in Leicester on 21 April 2011.

To be fair to the tribunal service they wrote to me many months ago to say that the judge was on sick leave and that alternative arrangements were being put in place.
