Hi guys

Does anyone know if the clients UC housing element is reduced to 50p (£2.17) if subject to benefit cap or whether the UC total is reduced by the amount over the benefit cap?

Reason i’m asking is my client currently with partner & 4 kids on legacy bens & HB. Their HB is 50p pw. Her partner has left her so she needs to claim UC in her own right. Will still be subject to ben cap.

As she is in rent arrears we were going to ask for APA to pay her hsg assoc directly the housing element however do UC reduce the housing element and only pay the landlord the £2.17 per month or will they reduce the total UC & still split the rent payment & send to landlord ie £362.40 per month?

Hope that makes sense

Cheers

The total UC award is reduced, not any individual element, so the APA could be made for the full housing element.
