Partner living abroad

Client has lived here for 2 years with her disabled son. He is still undergoing treatment. Her husband lives abroad and sends money to her but his wage has decreased. She currently gets CTC/CHB but wants help with rent. If she claimed as a single person, would her partner’s full income be taken into account if she claimed UC? Presumably this would leave her worse off. She doesn’t get DLA at present.

It depends on whether the separation is permanent or temporary (i.e. more or less than six months). What you’ve said implies they separated two years ago, so they are not treated as a couple and his income/capital is not included.

They’re still a couple as such and her intention is to move abroad once her son’s treatment is complete. She is only here whilst he receives treatment.

There does not have to be a relationship breakdown ,  it is the partner’s absence of 6 months or more which results in them ceasing to be treated as a couple for UC purposes
