Entitlement to SDP.?
Cl has had serious mental health problems and has been in accommodation in the borough funded by NHS authority from his home area. First this was secure unit but for the last two years he’s been in a half way house. Mental health is much improved and he will be discharged in the next few months and will move to PRS. Cl has DLA - highest care, low mobility. Only the mobility has been paid due to his being in NHS accommodation.
Cl was on SDA but was transferred some time ago to ESA and placed in SG. I’ve only seen this year’s uprating letter but this shows no SDP in payment. Is there any rule that DLA care must be paid to qualify or is an award enough?

To qualify for SDP claimant has to be in receipt of the qualifying benefit http://www.legislation.gov.uk/uksi/2008/794/schedule/4/paragraph/6/made

Not sure whether you’re thinking about avoiding UC on his discharge but if you are, he could look to get the sdp put into his ESA as soon as he is discharged (assuming he will meet conditions) ie let ESA know and send off IS10. Once he’s done that then he should be precluded from claiming UC and could claim HB instead.

Is that a Scottish thing? Down here we still ring the normal helpline, well, I do at least.
It’s the Universal credit SDP helpline we have been told to use where we have to establish that the legacy benefit should be claimed rather than UC
