Claiming UC if you don’t have a National Insurance number

Hi all

We have a client who needs to apply for UC but doesn’t have a NINO,  he has an appointment to see someone in Manchester on 3rd January 2019 to apply for a NINO.

In the meantime the Jobcentre has sent him to us to apply for a temporary NINO.  HMRC say that isn’t possible anymore.  UC say it is not possible to claim without a NINO.

Has anyone else had the same problem and is there a way around it?

CPAG have seen this come up a number of times recently and have therefore prepared template judicial review pre-action protocol letters for advisers to use to challenge the non-payment of UC until the claimant has a NINo. (We have used them ourselves and UC has been paid pending the NINo being issued).
