A way out maybe?
Hello - I am thinking aloud here but need some guidance as to whether it can be done!
Client in receipt of UC and ESA C (support) - Partner on sick and is looking to claim ESA C - Client has PIP SRDL - Looking at a claim for PIP for Mr
If awarded - on legacy benefits - would look at Carers Allowance for both (underlying) giving rise to 2xSDP
So if Client closed claim for UC - Can they then ask ESA to look at ESAIR - as I believe this is COC not a new claim - Get double carers and double SDP??? and an entitlement to HB
I’m not sure if this is possible, I think the C-ESA becomes New Style ESA when a claim for UC is made and therefore no ir-ESA top up can be paid. If the partner claims C-ESA now it will definitely be New Style ESA as the claim is being made in a full service area (and hasn’t had an ongoing C-ESA award prior to FS UC area).
Can’t confirm where I found this (a while ago now) but will have a look and hope I’m proven wrong.
Here we go think it’s this thread: https://www.rightsnet.org.uk/forums/viewthread/13232/

According to QBC- the top up is Universal Credit.
