Moving from ESA-IR to ESA-C only
My client is receiving ESA-IR as a single person in the support group. She has just moved in with her partner who is self-employed. They live in UCFS area. They don’t want to claim UC as the partner doesn’t want to declare his earnings. Can she remain on ESA-C and just lose her EDP or does she have to claim NS-ESA?
as the partner doesn’t want to declare his earnings.
that’s a bit worrying. money laundering, tax avoidance, and all that….

No, just a private person apparently Claire
If her current ESA is comprised of contribution based and income related ESA, then yes she could just lose the income related without needing to make a new claim. If partner is working 24 hrs or more per week that rules out income related ESA regardless of his income - so might be simplest just to declare that.
Thank you Jane.
