AS v SSWP (CA) [2015] UKUT 592 (AAC) [2016] AACR 22
I have a complete inability to understand how to find decisions under the new case referencing system.
Sweet and Maxwell flags AS v SSWP (CA) [2015] UKUT 592 (AAC) [2016] AACR 22 by Judge Wright as being authoritative about disclosure by telephone in relation to overpayment recovery, can anyone help me with a link to find the damn thing please?
Many thanks, yours technophobically….
Brilliant, thanks very much for swift reply Kieran, much appreciated.
To unpack those references (bit like understanding your DVLA driver number!):
[2015] UKUT 592 (AAC) is the main reference for the decision. That tells you it is UT Administrative Appeals Chamber (AAC) decision serial number 592 in the year 2015.
[2016] AACR 22 tells you it is serial number 22 of the AAC decisions selected to be reported in the year 2016
AS v SSWP (CA) tells you the parties and the benefit, but these details may not be unique so it is best to search by one of the index numbers (either reported or unreported) - not both at the same time. If you put too much in the search window you might not get a hit
Thanks Peter but I still can’t seem to get meaningful list of results.
This is by entering AAC 592 2015 https://www.gov.uk/administrative-appeals-tribunal-decisions?keywords=AAC+592+2015&tribunal;_decision_decision_date[from]=&tribunal;_decision_decision_date[to]=
This is with [2016] AACR 22 and Judge Wright selected as well https://www.gov.uk/administrative-appeals-tribunal-decisions?keywords=[2016]+AACR+22&tribunal;_decision_judges[]=wright-s&tribunal;_decision_decision_date[from]=&tribunal;_decision_decision_date[to]=
[eta] second link doesn’t work but basically, I still can’t seem to work out how to search for decisions and I’m not sure I ever will…...
Ah, that’s because you are searching on the new database for a decision that is on the old database. If you enter the case reference in the exact format of [year] UKUT serial number (AAC) on the new database and the case is on that database, it will be top of the search results. There might be other partial matches, but the exact match should come top
1. Decisions before January 2016 aren’t on the new website, the case that you’re looking at was decided in 2015 so it won’t show up no matter how good you are at searching. You will need to search the old website: http://administrativeappeals.decisions.tribunals.gov.uk/Aspx/default.aspx which is much more user friendly.
2. If the case is reported (like this one), you can find it on the index of reported cases: http://administrativeappeals.decisions.tribunals.gov.uk//Decisions/adminAppealsChamberReports.htm
3. You might have more luck using BAILII to find newer cases: http://www.bailii.org/
This one is also linked to on Rightsnet
https://www.rightsnet.org.uk/welfare-rights/search-all/search&channel=news|briefcase&keywords=AS+v+SSWP+(CA)+[2015]+UKUT+592+(AAC)+[2016]+AACR+22+&date-from=19980101&date-to=20181231/
Hmm, that link doesn’t work but you can search it on Welfare Rights caselaw
you can search rightsnet using any of the case references -
“CG/3549/2014”
“[2015] UKUT 592 (AAC)”
“[2016] AACR 22”
Thanks all. I’ll try to get this into my head but I cannot promise I won’t be posting similar threads in future.
OK - here is how it works for numpties like you and me Paul.
1. Ignore the reported number - e.g. [2016] AACR 22 - unless it is all you have to go on. If you’ve obtained the reference from the Sweet and Maxwell law Volumes you will always be given both.
2. Is the decision dated 2015 or earlier? - e.g. AS v SSWP (CA) [2015] UKUT 592 (AAC) is a 2015 decision. If this is the case, search on the old site.
3. When searching on the old site you need to stick the year (2015) and the neutral citation number (592) into the neutral citation number fields.
4. Is the decision dated 2016 or later? If so, search on the new site.
5. When searching on the new site, just enter the appellant’s initials into the search field - so for OL v Secretary of State for Work and Pensions (ESA)[2018] UKUT 135 (AAC) you just need to stick OL into the search field. With more common initials you may get four or five results, but you should be able to identify the decision you want from those.
3. You might have more luck using BAILII to find newer cases: http://www.bailii.org/
this
the citation is now this way because of BAILII
[2015] the year
UKUT 592 - tribunal & case no
(AAC) administrative appeals chamber (of UKUT)
if you go here on BAILII http://www.bailii.org/recent-decisions.html you find a list of all the different courts and if you click on one of those lists (here, Upper Tribunal (Administrative Appeals Chamber) you get to the list of the most recent 20 cases.
or if you put [2015] UKUT 592 (AAC) into the citation box on BAILII’s search page, it takes you straight to the decision in question: http://www.bailii.org/uk/cases/UKUT/AAC/2015/592.html
HTH
BAILII simplified citations no end, and now everyone uses them (save when they’re then also put in EG the All England Law Reports or whatever .... ALLER.
