Universal Credit and statutory sick pay

Wondering if anyone can help me with this.

My client is an employee of a private limited company. He’s also a director of that company. He is usually paid via PAYE (states net earnings of £2,000 per month).

Following a recent accident he is currently unable to work. He lives in a Universal Credit full service area. If he now pays himself statutory sick pay, would he be able to claim Universal Credit? And if he is eligible, which work related requirements would be likely to apply?

Any advice on this would be much appreciated!

SSP would count as earnings in the calculation of income, so would be subject to the 63% taper ...

He would still come within the ‘all work-related requirements’ group of conditionality, because he does not have Limited Capability for Work, and there is no provision for someone on SSP to be ‘treated as ....’.

He would be submitting a sicknote be asking for the work-search requirements to be ‘switched off’ or ‘reduced’ during his period of sickness, depending on what his actual limitations are ... and would be reliant on the discretion of the work-coach with whom he is negotiating this .... He can have the first 14 days.

Any other perspectives?
