Back dating to legacy after UC go live

Hi all, if a claimant lives in a UC ‘go live’ area, would they be able to claim a legacy benefit (eg tax credits) if there were grounds for 1 month backdating, which would take the claimant back before UC went live in the area ... I tend to think that the answer might well be ‘no’, but perhaps the backdating scenario makes a difference - otherwise the claimant has the double whammy of potentially less money on UC and losing out on backdating,

That is possible where an HB or IS claim was instigated before the UC commencement date.  For example submitting a claim after an initial enquiry within the previous month; patching up a defective claim.

But you generally cannot initiate a new claim for IS, HB or Tax Credits after UC commencement if you are the kind of person who would be eligible to claim UC - not even if the claim would have been treated as made on a pre-UC date.
