ESA and disability premiums
The man has been receiving ESA support group - contribution based - for a number of years. He also receives DLA at highest rate care and higher rate mobility. He lives alone and no one claims carers allowance. However, his ESA is only £109 per week. I would have thought he should be receiving ESA at a much higher rate to include disability premiums. However, when he asked at the local advice agency, they said that if he tried to claim any additional ESA, it would need to be a new claim, new medical. Could anyone clarify this? The man is just over 60 years of age.

He’s getting contribution-based ESA as incapacity benefit paid contributions and his conversion to ESA didn’t result in income-related ESA being paid. (Sorry if you already know this).
He needs to call up 0345 608 8545 and ask for an ESA3. This is just an income assessment and shouldn’t affect any parts of his ESA (although I suppose there’s always the risk of a ‘random’ reassessment) and definitely worth it for the additional SDP and EDP.
This should be backdated the whole way, but may require a bit of nudging on that front.

If it is a conversion from IB then worth having a look at this thread - https://www.rightsnet.org.uk/forums/viewthread/5928/ - it is incumbent on DWP to assess for income-related at point of conversion.
