18-21 housing cost and Live Service area

Hello

I am wondering if anyone can help?

I have a young person in supported accommodation in a full service area so they have personal allowance in UC and HB for rent, he is moving into a live service area and I cant work out from ADM6/17 whether they will need to apply for housing cost or continue with HB.

the DWP guidance discusses if a person has an award etc but there is nothing about if a person has 2 awards ie UC and legacy benefits.

We can argue the need to have housing cost as they meet the exemptions but just trying to work out if they should get HB still.  Added to this the ADM only talks about full service areas.

Depends whether he will be in specified accommodation after he moves.  If not, he will need to apply for a superseding decision adding a housing element to his UC.  If he times it right he could be in line for a windfall as his max UC for the monthly AP in which he moves will be based on his circumstances at the end of the month.

The HB award for the specified accommodation he is moving out of will end under the normal HB rules - generally from the end of the week in which he leaves, unless he is unavoidably liable for payments up to four weeks later.  In particular the HB rules on UC migration (where HB ends from the beginning of the AP in which a person moves to UC) do not apply here as the claimant is already on UC.

On the other hand, if he is still going to be in specified accommodation then the normal HB rules on change of address apply.  If he is moving to a different LA area he will have to make a new HB claim there; if not it’s a change of circs in the same LA area

thank you, you’re a star! - in terms of requesting a superseding decision would this be done by writing into the DWP UC address as he is live service there is no online journal

Someone with more direct experience of full service will hopefully confirm this but I think his claim will still be administered on the full service system even if he moves into a live service area.  Not entirely sure though.

My understanding, like HBAnorak, is that he remains full service - may cause some confusion at the jobcentre though as they won’t be used to full service claimants and the work coaches may not be geared up to using the online journal.
