Probably a daft question but help needed!
Can you advise?
We have successfully got a Tribunal Decision set aside that was made in October 2010 for an ESA appeal - can we now insist that DWP re-instate ESA payment pending a new Tribunal date as unfortunately our client did not follow our advice and re-claim ESA after the original appeal hearing.
All help appreciated.
Yes- the appeal is still ongoing and on that basis ESA should be reinstated.
