A8 nationals and changes from May 2011

Will A8 nationals who already have claims in for JSA (or HB, ESA) prior to them getting the same benefit rights as other EU nationals from May 2011 need to make a new in May?  Just wondering about people with existing claims, appeals etc who may have an arguable case for benefit before the change but definately will post the change need to also reclaim or will the DWP make a decision from 1st May onwards on these existing claims?

If a decision is made before the change in the law takes effect and the claim is disallowed then a new claim will need to be made.  If a decision is made after the change takes effect then the case can be considered under the new legislative position.
