dla supersession after 65

client aged 75 so pip not an issue
gets DLA LRM only indefinite award - wants a supersession. read cpag and its not clear. im reading it she cant get LRC only MRC or HRC. can she keep LRM and could she move to HRM. she hasn’t been this bad since before turned 65.

Your client can qualify for MRC or HRC provided she meets the relevant conditions for entitlement for at least 6 months (in line with AA qualifying conditions). This is effectively to substitute for not being able to claim AA now due to the preexisting DLA claim.

However, the award of LRM is fixed, and she is unable to be awarded HRM, as you state that she doesn’t have a condition which may have bought about a higher entitlement prior to reaching 65 years of age.

Remember also that any request for a supersession does mean that the existing award can be increased, confirmed, or removed.
