One of my clients just phoned me.He has been off work since last April and is awaiting another op . Sick Pay ran out so had to claim ESA. No decision letter yet,advised been placed in WRAG group (which we will appeal anyway) but has been phoned to attend a Work Focused interview.He already has a job that he plans to return to, and will be supported by his Occ Health (major employer).

I am sure I read on here that people with jobs didn’t have to attend those-or did I make that up? If I didn’t-is there a link to this?

See the Ask CPAG info What conditionality will you have to satisfy while claiming ESA?

Are you exempt from conditionality?

You are exempt from the requirement to attend WFIs if you are:

* in the ESA ‘support group’ i.e. you have ‘limited capability for work related activity’; or
* a lone parent with a child under one; or
* starting or resuming work (or likely to do so) and a WFI would not assist you

Thats fabulous thanks! Am trying to find the reg for this-does anyone know? Tried Sweet and maxwell and googling-getting nowhere!
