I have a client who is in the process of gathering evidence for his Permanent Right to Reside Certificate application. The client has lived in London since June 2010 as a worker, student and a jobseeker and has most of the evidence required apart from the comprehensive sickness insurance. I wondered how important it is to provide this and what happens in cases where they can’t? If he obtains one now would that be OK? Or does he have to evidence it for the periods he is using his student status?

I cannot find any information about this.

I was using this case in a recent GPoW decision appeal for a German National who had been living with her UK citizen partner and living off his wages- therefore self-sufficient, but without any sickness insurance. The client pulled out of the appeal, so it never went to a tribunal, so I can’t advise if the Brey case would have been weighted in these circumstances!
