Continuation of Mortgage Interest Payments.

Hi All,

This may seem like a silly question but can’t find an answer anywhere.

A client that was receiving JSA and mortgage interest payments, who is signed off work as sick by his GP and makes a claim for ESA, can his mortgage interest payments continue without making a new claim?

If a new MI12 does have to be completed client should not have to wait the 13 week waiting period again should he? 

It’s just that I have been informed by an operator at the DWP that he has to complete a new MI12 and will have to wait the 13 week waiting period again.  I am sure this is incorrect!!

No, does not have to serve new waiting period.  Covered by linking rules.  See CPAG handbook p846 and DMG 44578.  As such, would not expect have to complete new MI12.  Would suggest you ask someone with the Mortgage section at the BDC dealing with the claim to contact you to verify that this is the case as generally other frontline JCP staff and DMs are not familiar with rules around HCs.

Thanks for your response I did find the information regarding linking rules in the end…Although the DWP are insisting the client completes a new MI12 form, so will try and contact the Mortgage Section, although the DWP are very reluctant to provide any numbers or pass you on!! They say they will pass on a message and someone will call you back but no one ever does.  SO frustrating!

We are meeting with the DWP next week so hopefully this problem will be resolved!!

One possible consideration.

If you’re client is within the 2 year SMI limit group, and nearing the end of it, it might be worth taking a 13 week hit in order to get another 2 years interest support, if that’s the result of their decision?
