13 week protection - LHA
After a bit of help please.
I have a tenant who is currently a joint tenant and they could afford the full rent and have not claimed HB in the last 52 weeks.
They have now separated and the tenancy will be transferred to his sole name.
He only works part time and would be eligible for HB.
Would he eligible for the 13 week protection ?

Yes he would, a partner or a joint tenant moving out of the property doesn’t make a difference to the fact that he could afford the rent when he signed the agreement, his circumstances changed after that.
