If a person is working, and then claimed ESA, can he argue that this is permitted work if the permitted work criteria apply to him, or can permitted work only be done once you are in receipt of ESA?

This has come up before.

I’ve yet to encounter a client who has had a problem with existing work being accepted as PW following a new ESA claim and I seem to recall the general consensus was that there is no mechanism to prevent this being the case.
