Attending a tribunal while serving a prison sentence
I have been asked whether it would be possible to attend at tribunal while being At Her Majesty’s Pleasure.
I can see that something called Special Purpose Leave exists, from my ‘wide’ study of prison internet resources.
Has anyone got any experience of this being granted to attend a tribunal?
If the circumstances were compelling enough to get the tribunal heard ASAP, is it worth a try?
We had a case where special leave was refused but we managed to get video conferencing arranged
Thanks - that’s very helpful to know.
I had a case where special leave was granted and a prisoner attended a tribunal (handcuffed to one guard, with another in attendance)
Whilst I can’t help with the main question at hand, do be aware that the phrase “At Her Majesty’s Pleasure” is a very specific sentence, and doesn’t just refer to being in prison in general. AHMP refers to indefinite sentences where a life sentence may not be appropriate (e.g. serious young offenders), most notably in recent years the sentnces handed down to Jamie Bulger’s killers.
Thanks for the further replies.
Perhaps my ‘wide’ study of prison related internet resources wasn’t quite wide enough.
Some prisoners, such as category A prisoners, are excluded. As are those, surprisingly enough (ahem) on the escape list.
On a couple of occasions I have repped at tribunals which have taken place in prison.
