My client is on DLA high rate of care component and no other income

He is in rent arrears for more then 10K - Principle home (facing eviction and the solicitor is acting on his behalf)

He inherited the house (classed as his second home) that he is trying to sell for 3 year. If sold he will have more then 50K but the

situation is very uncertain.

I’m aware of the rule re: capital but is there any case law that I could apply to enable him to get Income Support?

Why is he not on IB / Income Support, JSA (IB) or ESA (IR) now?

Also worth looking at whether the DLA could be increased. Could he qualify for low or high rate mob?
