PIP claim -  lack of medical

client   has claimed PIP but due to traunmatic experiences of medical re ESA and LT re same cannot cope with a further medical - will her claim be decided   on the   form she   has completed?

Reg 9 specifies that where a claimant does not attend face-to-face assessment without ‘good cause’ then ‘a negative determination must be made’.

Reg 10 specifies that a claimant’s health and disability is to be taken into account when deciding whether there was good reason for not attending.

If the evidence is strong enough - they may be able to decide the claim ‘on scrutiny’ by looking at the paperwork only.

If this is the case it might be worth sending a cover letter clearly specifying which point scoring descriptors you have already evidenced to ensure the assessment provider do not just treat it as a ‘standard claim’ requiring a face to face (which in my experience they will do in >90% of cases).

I would also suggest laying out why the claimant is physically or mentally unable to attend a face to face assessment, whether at an assessment centre or at home, in the same letter.
