ESA and Hospital in patient 52 weeks plus

Scenario : Young person left education and claim for Income related ESA was made at the time (before that mam received full Child Tax Credit)
Aged 19 he was placed in Support Group and receives full entitlement
He now resides in specialist hospital setting and this will shortly be coming up to 52 weeks

He will now fall back to the Basic rate only but will this be £57.35 or £72.40 ?

As I look to the regs I believe it to be the under 25 year old rate but I would hope it was not ?

Also he goes on home leave at times , during which we will activate underlying PIP
but as these periods are not an actual discharge I take it that it would not re-instate the ESA premiums either ?

I understand the <25 rate only applies during the assessment phase.

That’s right - it’s set out in Schedule 4, part 1, para 1 of the ESA regs - provided you have passed the WCA then the single allowance is £72.40
