PIP supersessions - what happens if a claimant reports deterioration but then does not return form?

Has anyone come across such an issue as yet?

A colleague has recently seen the attached letter which threatens that the ‘claim to PIP may be disallowed’ and has queried what exactly happens in such circumstances. PIP enquiry line advised them that if the PIP2 form is not returned, the entire award will end.

Looking at reg 8, I think that this is the case. It certainly gives the DWP authority to request information from the claimant (e.g. where a change of circs is reported) and if nothing is returned, reg 8(3) specifies that ‘a negative determination in relation to the component to which the failure related must be made’.

Any thoughts?

obviously i could walk over and talk to you tom but you’re not at your desk and then noone else would see…

i agree with what you say so definitely need to be wary if requesting pip supersession. But interestingly there might be an argument that they should only stop one component if you only asked them to look at one
