I have had discussions with a top tribunal judge. She informs me that the DWP are requesting leave to appeal and appealing all successful appeals to the UT. Has anyone seen the submissions the DWP use and isn’t the rep supposed to get copies?

Secondly, if the FTT finds in favour of the appellant am I correct to argue that HB ought to be reinstated to the level without the over occupancy charge reduction?

As always thanks for your help.

i have never had the dwp appeal a tribunal i have won but i assume it would just be the reverse of when we do it and the dwp get to see our application and either support or argue against it.

unfortunately, i think the dwp can refuse to pay out until the second tier appeal has been decided but again i havent had to look at it in real detail as it hasnt happened to me.
