sorry if i am just being dense or can’t find my statutory instrument for the trees but can someone link me to the SI bringing in the minimum earnings threshold for hb

You mean for effective and genuine work?

No SI - just a guidance circular issued in March.  The law hasn’t changed, it’s just that DWP would like Councils to set the bar at that level when deciding whether a case needs close scrutiny.  Before that a lot of Councils probably set the bar lower - 16 hours was a popular rule of thumb and on the minimum wage you would only earn about two thirds of the threshold.

Important thing is that no-one should be using it for an automatic refusal of benefit where earnings fall below that threshold - and that was never DWP’s intention to be fair (although they wanted the newspaper reading public to think it was and probably succeeded in that)
