Council tax exemption on grounds of SMI. I have a client who satisfies the medical requirements as GP has signed form. However only on low rate care DLA, and other benefit requirements include IS with a DP or Incap Ben. However she is on ESA (WRAG). This means she doesn’t appear to qualify. Not something I have dealt with much, but were CTax rules not updated to include ESA or was ESA deliberately excluded?

Longer term solution will be when a PIP claim is considered, but otherwise she seems to still be liable?

Am I missing anything?

Have sent info to Local Authority re ESA and have asked to change their decision. Thanks for reply.
