In my experience tribunal panels take the role of the DWP. We should be insisting that HM Courts and Tribunals issue a statement condemning the article. Personally I welcome POs because they usually help rather than hinder the process.

That’s because the role of the presenting officer is intended to be a friend of the tribunal, to assist the members in understanding the legislation and it’s effects. This is one of the seriously fundamental flaws of both articles, the notion that somehow a PO has the role of a prosecutor.
