Stare decisis.
one could equally argue that this UT decision on the stare decisis point vis a vis the high court is irrelevant, since it followed the higher authority of the court of appeal, which trumps both. bearing in mind that the high court decision was in a case which ws not fully argued, HMRC having taken no part in it.
