DLA and over 65’s

Hi,

I was wondering if someone aged 65 who is already receiving DLA (HRM only indefinite award) and who has care needs now has to claim PIP if they wish to claim for their care needs or if they can still ask for a supercession of their DLA claim? I’m in Wales and I know that anybody under 65 has to claim PIP in these circumstances but I’m not sure how this affects older people.

Hi - I think the person’s date of birth is the key here. If they turned 65 on or before 8/4/13 then the DLA rules apply. Turning 65 after that date leaves them in the PIP-able category.
