My client is paid for looking after 3 children - court order

Do you know whether this income is regarded for HB/CT purposes?

Hi Dina, you will need to find out a bit more about the type of payments to resolve this.

For example some payments such as those made under a Residence Order or Special Guardianship Order are taken as income but other payments such as those made under fostering provisions are disregarded.  The type of order and payments will also determine whether the children are included in the applicable amount or not.

To complicate the situation further, the situation may be different if the HB claim is for someone over pension age.

Hi Dina,

You will find a straightforward overview in the Guide to HB/CTB (Zebedee, Ward and Lister) if you have access to a copy see page 230 onwards. Generally if the payments are in respect of fostering, boarding out or respite then they should be disregarded in full. Other payments as noted in the post above will need further exploration.
