ESA and transitional additions
Claimant has been getting Contribution Based ESA of £128.10 which includes £28.95 transitional addition. His IIB has been paid in addition. He was in the WRAG and on completion of 365 days he has lost the transitional addition. Is this correct? I can’t find any reference to TA stopping because claimant moves from CB to IB ESA.

Apparently it is correct - there was an article about common ESA enquiries in the most recent addition of The Advisor, and this was mentioned. Unfortunately cannot lay my hands on my copy right now - any CAB colleagues like to chip in with the actual Reg?

The way i see it is that the benefit is a contribution based benefit, and if in WRAG then your contribution record expires with regard to said benefit after 365 days, and therefore it becomes a claim for a different benefit (Income related ESA)
I think that because its now a different benefit then the transitional protection goes as well, unless any of our Learned friends can advise otherwise?
Not sure how LCW linking rules apply here, if at all. LCW can be linked but i dont think that has anything to do with the benefit rates in question, unless i am mistaken (probably!)
