I’m a tad busy to go delving into the regs on this at the moment so some clarity would be appreciated.  Client, partner and 2 kids, on ICB (she is definite about being on ICB and appeal papers say so too) and IS.  Fails conversion, appeals and gets placed in the support group.  DWP say as she has a partner her award falls to be one of IR/ESA and because partner has now started work she is not entitled to benefit only credits.  Should I declare myself insane and admit that I now know nothing about benefits after all or is there some little detail that I’ve overlooked.

I justcan’t seethis. Her appeal backdates the start of her ESA so that it links to her Incapacity Benefit. Even if put in WRA group she should have her year of contribution-based benefit.    Ruth

That’s my understanding exactly.  The award of ICB converts to one of Con/ESA and the award of IS converts to one of IR/ESA.  I’m beginning to doubt my own name.
