Can both of a couple claim Income-Related ESA?

Hi

I have a client whose wife is claiming Income-Related ESA and who is in the work-related activity group.  The client has not paid enough national insurance contributions to claim Contribution-Related ESA.  Can the client make a claim for ESA to ensure that he receives national insurance credits and that the couple have “two bites of the cherry” at the work-related activity group and the support groups?  If so, what form will they have to fill in?

Yes.

Probably easier for partner not currently claiming to complete an ESA1. The automata at JCP will understand that better than claimant giving them an ESA3 with a sicknote for her partner.

That’s worked for me recently anyway.
