DLA FOR CHILD - SCHOOL REPORT

Hi there

Have appeal next week, trying to find case-law.

Child aged 11, was on MRC plus LRM. All removed on renewal, mainly due to school report which said no problems. Has letters from GP plus consultant which support both care/ mobility needs.

I seem to remember a UT decision on needs outside the structured environment of school.

Can anyone point me in the right direction, or on any other case-law that might help in this situation?

I do a lot of kid’s DLA appeals and I see this all the time.  Pro-forma questionnaires sent to the school with no information as to the real relevance of the information being sought.  The school, running scared of Ofsted, says everything’s fine.  I write to the school with a covering letter and get a report back (sometimes from the person who completed the first report) saying well, erm, actually, now that you point it out, little Johnny is really quite a handful, etc, etc.  CD you want is attached.

Paul or anyone?

Can you refer me to the UT DLA decision about diagnosis not needed? Child has suspected autism as well as other issues, awaiting specialist appointment - appeal next week.
