Transitional protection when the client is moved from contribution-related ESA to income-related ESA.

Hi

I have a client who was migrated from Incapacity Benefit to the work-related activity group of contribution related ESA.  She was awarded contribution-related ESA of around £108.05 a week, this included a transitional amount. A year later the client is transferred from contribution-related ESA to income related ESA because she has spent 365 days in the work-related activity group.  However, her ESA is reduced to £100.15 a week because the transitional amount has been removed.

Is this correct?

Here is a thread on this very subject. It would appear that the transitional “top up” is indeed dropped when there is a change in circumstances such as the end of the 365 entitlement and move to IRESA;
