Explanatory notes say “Regulation 12BA….also provides for a protected eligible rent for up to 12 months where certain members of the claimant’s household have died. This is based either upon the actual rent or, in the case of an existing award of housing benefit, the previous eligible rent.”

Does anyone know who “certain members of the claimant’s household” are??

We have a tenant who has just died. She lived in a 3 bed flat with her adult grandson. She was the HB claimant, he was a non dep. If he succeeds to the tenancy and claims HB will he be protected for 12 months?  I suspect not but can’t find any detail.

Any ideas?

Off the top of my head, “certain members of the household” refers to family members (close relative, grandparent/grandchild, niece, nephew, uncle or aunt according to my notes), but it’s there to exclude lodgers, boarders, and unrelated joint tenants.
