JSA entitlement after succcessful ‘living together’ appeal where claimant had stopped signing-on

Hi

Client packs in job, separates from partner but doesn’t move out.

His JSA(IB) claim is rejected as they are deemed to be LT (partner works FT).

He appeals LT decision but (I think) stops signing on.

Tribunal finds in his favour but arrears are only paid up to his last signing day.

I’ve found CJSA/4196/2006 which found that a Tribunal had effectively reinstated a JSA award for an indefinite period (dispute over failure to sign-on) but I could swear I’ve seen (imagined?) another UTT decision which held that failure to sign-on in circumstances such as my client’s should not mean he doesn’t get his arrears for the whole period as long as other conditions are met?

If I get another of these I might tell em to carry on signing-on. Not occurred to me before that it might be an issue.

Just to confirm successful ending to this one - JCP coughed for £1200. Clt v pleased. Good stuff.
