Hi All,

Does anyone have details of an appeal that is due to be heard soon- Iam looking for :

MS v SSWP (JSA) 2011 (sub nom.Szpak v Secretary of State for Works and Pensions).

A tribunal judge in his directions recently suggested that we may want to wait for this hearing to take place as it could impact on our case. Our client applied for a Worker Registration Card and worked for an employer, but then left due the the employer going out of business.

Any help appreciated- Thanks

Hi,

This is from http://www.administrativeappeals.tribunals.gov.uk/Decisions/casesPendingHigherCourts.htm

‘Szpak v Secretary of State for Work and Pensions
A8 registration – (whether registration certified under the A8 workers scheme was retrospective to the start date of employment)
MS v Secretary of State for Work and Pensions [2011] UKUT 452 (AAC)
(Same issue as SSWP v ZA [2009] UKUT 294 (AAC), which was settled by a consent order)
Permission to appeal given by Upper Tribunal Judge on 10.11.11
(Block of at least 10 cases in the AAC)
Float on 23-Oct-12 or 24-Oct-12’

There is a little bit more detail in Judge Ward’s decision which there is a link to from the page above. CPAG’s CRO in London currently have a similar test case as well: http://www.cpag.org.uk/content/ce9782011-polish-national-lawfulness-2009-extension-wrs-proportionality-wrs

Hope that helps.

Jon
