Clients Wife is from Thailand - her passport is stamped no recourse to public funds. Client is in receipt of the guarantee credit of pension credit and he gets full council tax benefit for 75% of the charge of his property as he gets 25% for single occupancy.

We’ve told him that he needs to let the LA know that his Wife is now living with him however this will mean that the 25% single occupancy reduction will stop and he will be entitled to full council tax benefit on 100% of his council tax.

We have checked our and other information and it is far from clear whether this will mean that his Wife is inadvertantly in receipt of public funds as the CTB has increased due to her living there.  Could this have an adverse affect on her right to remain in the country?

Any thoughts or advice very welcome….please.
