problem with payments after winning DLA appeal

A client of mine has hit a brick wall.  He won his appeal, and should receive money backdated to January as well as future payments - problem is, he doesn’t have an account in his own name.  His partner receives their ESA into a joint account where she is sole signatory for some reason.  They won’t pay his DLA into this account.  He can’t open an account of his own because he has lost all ID in a recent flood in his previous home.  DWP say they will not pay anything by giro anymore.  Stalemate.  Any ideas?

As long as he has capacity then he can instruct them to pay into an account of his choice as long as there is no suggestion of impropriety or illegality.  Or they can issue a giro.  If they refuse to pay up threaten to sue them for debt in the county court and copy the letter to their legal department.  See how quickly they move then.

See reg 21(1) of the Claims and Payments Regs 1987.
