Tribunal set aside ...

The Tribunal Service (TS) have agreed to set aside a Tribunal’s decision because JCP failed to forward evidence to the TS that would have helped cl appeal.
My question is, cl appeal was re : unfavourable ESA decision and if TS have set aside tribunal’s decision should cl ESA be reinsated and backdated to 07/06/12 whn initial Tribunal was held ?
Having terrible trouble getting med. cert from cl GP that states her health has got significantly worse within 6 months of an unfavourable ESA decision, and cl is not suffering from any other illnesses ...

are you asking if he should still be getting assessment phase ESA while awaiting the new hearing? I would say yes
