See 4.37.1.3 paragraph 45 onwards for some clarification.
See paras 16 and 17 of schedule 9 (capital disregarded) and para 16 of schedule 8 (disregarded income other than earnings) of the ESA Regs. Thus the capital itself falls to be disregarded and regular payments from the capital also fall to be disregarded if the paras apply.
