Client has been awarded ESA £123.24 from 31/03/2012. no increase due to teansitional protection.

Letter issued 18/02/2012 advising IB £128.14 from 12/04/2012..

DWP advised that he would need to stick with £123.24..

1st time I’ve come across this as it is usually an appeal for nil points…

How much was their IB before transfer?

current award £120.39
received letter advising IB increasing to £128.14..
then received award letter for ESA at rate of £123.24…

my initial though being that the decision to award IB at the higher rate was made prior to decision to award ESA at a lower level..

Awards of IS/IB are transitionally protected when transferring to ESA, but they will not be increased with uprating and so should gradually go down to ESA levels.

As you say, it looks like the IB uprating letter was produced before the transfer happened
